Teknolojik gelişmeler ışığında yeniden şekillenen küresel ekonomi, pek çok kavram ve kurumu kendi ihtiyaçları çerçevesinde değiştirmiş ve güncelleştirmiştir. Bu kurumlardan biri olan milletlerarası ticaret, küresel ekonominin ana unsurlarından belki de en önemlisidir. Kuşkusuz değişmekte olan koşullar milletlerarası ticaretin yapısını da çağın ihtiyaçlarına göre şekillenmeye zorlamaktadır. Milletlerarası ticaretin gelişiminde son derece önem arz eden uyuşmazlık çözüm yolları ve özellikle tahkim müessesesi de bu şartlardan etkilenmekte ve değişen yapı içerisinde yerini almaktadır.
Güncel koşullar çerçevesinde, milletlerarası ticarî uyuşmazlıkların çözü¬münde yeknesaklık ve belirlilik, uyuşmazlığın tarafları açısından ön plândadır. Bu nedenle, milletlerarası ticaretin yeni ihtiyaçları karşısında tatmin edici imkânlar sunabilen kurumsal tahkim müessesesi giderek daha fazla önem kazanmaktadır. Gerçekten de başvurulan kurumsal tahkim müessesesinin sunduğu imkânlar, uyuşmazlık çözüm sürecinin kalitesi bakımından son derece belirleyicidir. Bu açıdan ünlü bir deyişte belirtilen “Bir tahkim ancak hakemi kadar iyidir.” ifadesi belki de bir adım öteye taşınarak, kurumsal tahkim müesseselerini de kapsayacak şekilde kullanılmalıdır.

“Milletlerarası Ticaret Odası (MTO) Tahkim Uygulaması” isimli bu eser esas itibariyle Gazi Üniversitesi Sosyal Bilimler Enstitüsü Özel Hukuk Anabilim Dalı’nda Prof. Dr. F. Bilge TANRIBİLİR danışmanlığında Doktora tezi olarak hazırlanmış ve jüri üyeleri Prof. Dr. İhsan ERDOĞAN, Prof. Dr. Vahit DOĞAN, Prof. Dr. Gülin GÜNGÖR, Doç. Dr. Rıfat ERTEN’den oluşan tez savunma jürisi önünde savunularak oybirliği ile kabul edilmiştir. Tezde ileri sürülen görüşler yazara ait olup, Enstitü ya da diğer kurumların resmî görüşlerini yansıtmamaktadır. Eser kapsamında doktora tez metnine çoğunlukla sadık kalınmış olmakla birlikte, MTO Tahkim Kuralları’nda 2017 yılı itibariyle gerçekleştirilen değişiklikler metne yansıtılmış ve gerekli görülen bazı şeklî düzenlemeler yapılmıştır.

Çalışmamız kapsamında kurumsal tahkim usulleri içerisinde oldukça önemli bir yer tutan MTO tahkimi ayrıntılı olarak incelenmiştir. Türk doktrininde MTO tahkim usulünü, özellikle uygulama bilgisinin aktarımı yönüyle, bir bütün olarak inceleyen derli toplu bir çalışmanın henüz bulunmaması konunun tercihi hususunda önemli bir etken olmuştur. Bu yönüyle eserin hem uygulayıcılara hem de konuya ilişkin akademik çalışmalara katkıda bulunması ümit edilmektedir.
