The Publication as a Result of the Ever International Workshop on the Legal Regime, Technical, Scientific Research and Environmental Aspects of Underwater Cultural Heritage

This publication is the outcome of are the edited version of papers presented at the International Workshop on the Legal Regime of Underwater Cultural Heritage (UCH) and Marine Scientific Research (MSR) held on 4-5 October 2018, at Bodrum, Turkey. The Workshop was organised by the Ankara University Research Center of the Sea and Maritime Law (DEHUKAM) in conjunction with the University of Virginia Centre for Oceans Law and Policy (COLP). It was sponsored by the Republic of Turkey Ministry of Development, the Delegation of the European Union to Turkey and the Turkish National Commission for UNESCO. This was DEHUKAM's second international workshop following the first of the Legal Status of Submarine Cables, Pipelines and the Area Beyond National Jurisdiction (ABNJ), held on 7-8 April 2016, Ankara, Turkey. The Workshop coincided with the celebrations European Year of Cultural Heritage 2018 and constituted Turkey's contribution to those celebrations. As the title suggests, the two main areas of the Workshop were the legal regime of and marine scientific research. The Workshop was attended by over 150 delegates from all over the world and speakers included some of the most prominent scholars and policy makers on the subject on this planet. More importantly, there was high a powered delegation from the Directorate and Secretariat of UNESCO's Convention on the Protection of Underwater Cultural Heritage, 2001 Paris, France. Although the subject might have been discussed elsewhere before, it is safe to say this was the first international gathering of its type on UCH. The discussions and exchange of views reflected the interdisciplinary interface between law, archaeology, history, policy and marine scientific research.

The choice of Bodrum could not have heen more appropiate concerning concerning being the home the home of the Turkish National Museum for Underqater Cultural Heritage. Most of presenters included those that formed their national delegations to the negotiations and drafting leading to the 2001 UNESCO Convention. The 2018 papers contained in these proceddings are organised under 4 major Parts: 3 under Technical Aspects of Underwater Cultural Heritage; 10 under the Legal Regime of Underwater Cultural Haritage, and 3 under the Legal Regime of Marine Scientific Research; and 2 under the Legal Interconnetction between the Marine Scientific Research and International Environmental and Cultural Heritage. The papers contained in these proceedings examined the strengths and weaknesses and the contrasts between the United Nations Convention on the Law of the Sea. 1982 (UNCLOS) and the UNESCO Convention regarding the Protection of Underwater Cultural Heritage, 2001. We, as the co-editors, are humbled by the depth and quality of the papers in this Proceedings. We, accordingly, commed them to the reader. It is hoped that the Workshop together with these proceedings will contribute to the understanding of the risks faced by underwater cultural heritage from treasure hunters, oil and gas exploration and other state sponsored projects and thereby lead to their preservation and protection for the benefit of future generations of the human race. Furthermore, it is also hoped it will in the process lead to more understandings of the UNESCO Convention on the Protection of Underwater Cultural Heritage, 2001. It should be noted that this publication could not be accomplished without the hardwork of the all DEHUKAM staff including the volunteers, and we are thankful to them.
