Tahkimde Davanın Açılması: İlk Dilekçeler ve Hakem Seçimi / Launching Your Arbitration: The First Submissions And Choosing Your Arbitrator

Bu mütevazi kitapta, İstanbul Tahkim Merkezi (ISTAC) ve Peter & Kim (veya o zamanki haliyle Peter & Partners) tarafından 21 Eylül 2018'de İstanbul'da düzenlenen "Tahkimde Davanın Açılması" konferansındaki sunumlar yer almaktadır. Fotoğraftan görüldüğü üzere bu konferans, farklı hukuk kültürlerinden gelen, farklı geçmişleri olan ve hatta farklı kuşaklardan konuşmacıların bir araya geldiği mutluluk verici bir etkinlik olmuştu. İlk panelde, Daniel Greineder, Flore Poloni ve Candan Yasan Tepetaş ile ikinci panelde Ziya Akıncı, Paolo Michele Patocchi ve Wolfgang Peter tarafından gerçekleştirilen sunumlar bu kitapta yer alıyorlar. Bu paneller, iki moderatörümüz Lucy Martinez ile Harold Frey'in katkıları olmadan böyle bir başarıya ulaşamazdı. İlk panelde, bir tahkim yargılamasını başlatan özet niteliğinde ama oldukça önemli iki dilekçe olan Tahkim Talebi ile Tahkim Talebine Cevabın hazırlanması ele alındı. İkinci panelde ise hakemlerin seçilmesinin sırları ile karar verilmesi aşamasında hakem heyetinin çalışmalarına ilişkin bilgi verildi. Konuşmacılar, sözlü katkılarını farklı şekillerde yeniden düzenlediler. Bazıları, bunları kısa makaleler olarak yeniden yazarken, diğerleri sunumlarına daha sadık kaldı. Konferansın canlılığını bir ölçüde yansıtabilmesi amacıyla konferansın tartışma kısmına da kitapta yer verildi.(SUNUŞTAN)

This little volume gathers the presentations from a conference "Launching your Arbitration", organized by Istanbul Arbitration Centre (ISTAC) and Peter & Kim, or Peter & Partners as it still was, on 21 September 2018 in Istanbul. As the pictures reflect, it was a happy occasion that brought together speakers from different legal cultures and backgrounds as well as different generations. The contributions of Daniel Greineder, Flore Poloni and Candan Yasan on the first panel, as well as Ziya Akinci, Paolo Michele Patocchi and Wolfgang Peter on the second panel are included. The events would not have been such a success without the contributions of the two moderators Lucy Martinez and Harold Frey. The first panel addressed the art of writing a Request for Arbitration and Answer to the Request for Arbitration, the two short but essential briefs that launch any arbitration, and the second panel provided insight into some of the mysteries of appointing a tribunal and the workings of a tribunal as it reaches a decision. The speakers have reworked their oral contributions in different ways. Some have rewritten them as short articles, while others have stayed closer to their presentations. To give a flavour of a live and lively occasion extracts from the discussions are included.(FROM THE PREFACE)
